Africa Creates Terms of Service

1. About Us
Africa Creates (africa-creates.com) is an online store offering products made by African and diaspora makers. The store is owned and operated by 54Commerce LLC, a Delaware limited liability company based in the United States ("Africa Creates," "we," "us," or "our").
When you place an order, you are buying from 54Commerce LLC. We are the seller and merchant of record for every order, and your receipt and any refund come from us.
By using the site or placing an order, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the site.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to place an order. By placing an order, you confirm that you meet these requirements.
3. Your Account
You may check out as a guest or create an account. If you create one, you agree to provide accurate information and keep it up to date. You are responsible for keeping your password secure and for activity on your account. Please tell us right away at [email protected] if you suspect unauthorized use.
4. Orders
4.1 Product information. We work to describe and photograph products accurately. Many items are handmade, so small variations in color, size, pattern, or finish are part of their character and are not defects.
4.2 Order confirmation. Your order is an offer to buy. A binding contract is formed only when we send you an order confirmation email.
4.3 Cancellations by us. We may decline or cancel an order, including after confirmation, if an item is unavailable, a price or description was clearly wrong, or we suspect fraud or unauthorized use of a payment method. If we cancel, we will refund any amount you paid in full.
4.4 Cancellations by you. You may cancel an order within 24 hours of placing it, or at any time before it ships, by contacting [email protected]. Custom or personalized items cannot be cancelled once production has started.
5. Prices and Payment
5.1 Prices. Prices are shown in US dollars (USD). Shipping costs and any applicable sales tax or VAT are shown at checkout before you pay.
5.2 Payment. Payments are processed securely by our payment processor, Square. We do not store your full card details. By placing an order, you authorize us to charge your payment method for the total shown at checkout, including the item price, shipping, and applicable taxes.
5.3 Taxes. Where required by law, we collect and remit sales tax or VAT on your order. It appears as a separate line at checkout and on your receipt.
6. Shipping and Delivery
6.1 Where orders ship from. Products ship directly from our makers' workshops, many of them in Africa. Each product page shows its estimated processing time, and checkout shows the estimated delivery window.
6.2 Estimates. Processing and delivery times are estimates, not guarantees. International shipments can be delayed by carriers or customs.
6.3 Tracking. We send a tracking number by email once your order ships.
6.4 Address. Please make sure your delivery address is complete and correct. We are not responsible for orders that cannot be delivered because of an incorrect address, though we will help where we can.
6.5 Customs and import charges. International orders may be subject to customs duties, import taxes, or fees charged by your country on delivery. These are your responsibility and are not included in our prices unless checkout says otherwise.
6.6 Lost or late orders. If your order has not arrived within 10 days after the latest estimated delivery date, contact us and we will investigate. If it cannot be located, we will send a replacement or give you a full refund.
7. Returns and Refunds
7.1 Damaged, defective, or not as described. If an item arrives damaged or defective, or is materially different from its description, contact us within 15 days of delivery. We will offer a replacement or a full refund, including original shipping. We may ask for photos, and we may ask you to return the item at our expense.
7.2 Change of mind. We do not accept change-of-mind returns, except where the law gives you a right to cancel (Section 7.3).
7.3 EU and UK buyers. If you live in the European Union or United Kingdom, you may cancel your purchase within 14 days of delivery without giving a reason. Custom or personalized items are excluded where the law allows.
7.4 Items we cannot take back. Custom or personalized items cannot be returned unless they arrive damaged, defective, or not as described.
7.5 How to request a return or refund. Email [email protected] with your order number, the item, the reason, and photos if relevant. We aim to respond within 2 business days.
7.6 Refund timing. Approved refunds go back to your original payment method within 5–10 business days. Your bank may take longer to show the credit.
8. Problems with an Order
If something goes wrong, please contact us first at [email protected]. That is usually the fastest way to a resolution, and we will work with you and the maker to fix it. You keep any rights you have with your bank or card issuer.
9. Acceptable Use
When using the site, you agree not to:
- break any law or use the site for fraud;
- interfere with the site's operation or security, or introduce viruses or malware;
- scrape, copy, or harvest site content or data by automated means without our permission;
- post reviews that are false, defamatory, obscene, or include personal contact details;
- buy products for commercial resale without our written permission.
10. Intellectual Property
The site's design, text, graphics, logos, and code belong to 54Commerce LLC or its licensors. Product designs and photos belong to the makers and are used with their permission. You may not copy, modify, or distribute site content without our written permission.
11. Privacy
Our Privacy Policy (africa-creates.com/privacy) explains how we collect and use your personal information. To ship your order, we share your name, delivery address, and phone number with the maker fulfilling it. Makers may use this information only to ship and support your order.
12. Disclaimers
The site is provided "as is" and "as available." We do not guarantee that it will be uninterrupted or error-free. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived, including rights relating to faulty goods.
13. Limitation of Liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential losses arising from your use of the site or your orders. Our total liability for any claim relating to an order is limited to the amount you paid for that order. These limits do not apply to liability that cannot be limited by law.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, and disputes will be resolved in the state or federal courts located in Delaware. If you live outside the United States, you keep the protection of any mandatory consumer laws of your country of residence.
15. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date shows when they last changed. Changes apply to orders placed after they are posted.
